Filing a Copyright in India:

Copyright filing in India can be done either online or offline mode.  Form XIV which is for Statement of Particulars and Statement for Further Particulars is to be filed and an appropriate fee towards the copyright registration should be made. This form can be filed either by reaching the official website of the copyright department or by mailing the form to the office of the Registrar of Copyright.

Details required for filing of Copyright:

Various details and documents are required for filing of copyright application in India, few of them are as follows:

  1. Name and Address of the Applicant
  2. Title of the Work
  3. Language of the Work
  4. Nature of the Work (Literary or Software or Artistic etc.)
  5. Name, Address and Nationality of the Author (Creator)
  6. Power of Attorney
  7. 3 Copies of Work

Other details are depending on the nature of work and involvement of other persons for example for the copyright of software if the applicant is not the author; a NOC is required from the developer (author).

Examination of Copyright application:

After filing the copyright application and making the payments of fee towards the copyright registration, the application is under the process and the first stage is a mandatory 30 days waiting period and that application is examined by the department during this period. In case, If there are any objections or shortcomings in the application that will be communicated to the attorney of the applicant or to the applicant itself as the case may be. That objection or shortcomings are to be removed and a reply for the same is to be filed within 30 days from receipt of this examination report.

The Registrar will re-examine the work after response filed for objection along with documents for shortcomings, and if he is satisfied with all the details the application will be forwarded for registration else there will be a hearing for the same.

Once, all the objections or shortcomings are removed the work will be registered and a copyright certificate will be granted to them.

Fee for Copyright in India:

The copyright fee in India depends upon the nature of the copyright. There is no fixed fee for all types of copyrightable material, it starts from as low as Rs. 500/- detailed fee chart is given below:

Term of Copyright:

The general rule is that copyright lasts for 60 years. In the case of original literary, dramatic, musical and artistic works the 60-year period is counted from the year following the death of the author. In the case of cinematograph films, sound recordings, photographs, posthumous publications, anonymous and pseudonymous publications, works of government and works of international organizations, the 60-year period is counted from the date of publication.
